Warranties and Liability
1 Legal Guarantee
Backed by a 5-year structural warranty on the Birch Plywood chassis and a 2-year warranty on all electric drive and battery systems, starting from the date of delivery. We are responsible for any defect that exists at the time of delivery and becomes apparent within the warranty period.
2 Characteristics of the Materials
As our furniture is made of plywood, textile (upholstery), and high-resilience foam, slight variations in the texture and color shade of the plywood, as well as the upholstery and coatings, are possible. Deviations in color and structure between individual parts of a piece of furniture or in relation to other pieces of furniture made of the same material are possible and are customary in trade. These minimal deviations, which are characteristic of the materials, are not considered defects.
3 Procedure for Defects and Replacement of Components
If you find a defect in the product, you are obliged to notify us immediately by providing us with photos or other evidence of the problem. After we review the case, we will offer one of the following solutions at our discretion: repair of the defect, replacement of the product with a new one, a partial refund, or a full refund, depending on the nature of the defect.
In the event of a defect, we reserve the right to offer a replacement of only the specific damaged part or component of the furniture, instead of the entire product, as our furniture is constructed from easily assembled components. This option will be offered when it is possible and appropriate.
After the warranty period has expired, customers can request the production of a replacement component for an additional fee.
4 Limitation of Liability
Our liability is limited to the value of the purchased product. We are not liable for damages caused by improper assembly, use, storage, or maintenance by the customer.
Force Majeure
Except for the obligation to pay money hereunder, no delay, failure or omission by either party to perform or comply with any of its obligations hereunder shall be deemed a breach of these Terms and Conditions if and while such delay, failure or omission arises from a cause beyond the reasonable control of that party.
Indemnification
You agree to indemnify, defend and hold us harmless from and against any claims, liabilities, damages, losses and expenses related to your breach of these Terms and Conditions and applicable laws, including intellectual property rights and privacy rights. You will promptly reimburse us for our damages, losses, costs, and expenses related to or arising from such claims.
Waiver
Failure to enforce any of the provisions set forth in these Terms and Conditions and any Agreement, or failure to exercise an option to terminate, shall not be construed as a waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right to enforce each and every provision thereafter.
